If a low-born person tries to occupy the same seat with his superior, he should be branded on the hip and banished; or the king shall have his buttocks cut off.鈥�(281)

 

Medh膩tithi鈥檚 commentary (manubh膩峁�ya):

鈥�Superior鈥欌�攊.e., the 叠谤腻丑尘补峁嘺, who is always 鈥榮uperior鈥� by reason of his caste, even though he be 鈥榠nferior鈥� on account of his bad character. In the case of the other castes 鈥榮uperiority鈥� and 鈥榠nferiority鈥� are relative and comparative (so that everyone of them may be 鈥榮uperior鈥� and also 鈥榠nferior鈥�). It is for this reason that the text has used the term 鈥榣owborn,鈥� where the term 鈥榖orn鈥� shows that what is meant is 鈥榠nferiority鈥� by birth; hence on account of its proximity, the 鈥榮uperiority鈥� also should be understood to be by birth. This superiority by birth belongs to the 叠谤腻丑尘补峁嘺, irrespectively of other considerations, and he is never 鈥榠nferior.鈥� From all which it follows that the punishment here laid down is for the 艢奴诲谤补 who occupies the same seat with the 叠谤腻丑尘补峁嘺.

鈥�Hips,鈥欌赌攂耻迟迟辞肠办蝉;鈥斺赌�branded鈥� upon that. This 鈥榖randing鈥� is to be not mere marking with lime or saffron or such things; but it is to be indicative of the man鈥檚 having undergone the punishment; so that others might fight shy of the same transgression. Hence the marking prescribed is one that is ineffaceable, and should he done with an iron-nail or some such thing; as is going to be laid down below (8.352)鈥斺�楶unishments that strike terror, etc., etc.鈥�

He should also be 鈥�banished鈥� from the kingdom.

鈥�Sphik鈥� is the name of a part of the buttocks, on both the right and the left side. This he 鈥�shall have cut off.鈥� In as much as this is an alternative to 鈥榖randing,鈥� it is only the part, and not the entire buttock, that is to be cut off.

鈥�Tries to occupy鈥�;鈥攖he man is to be punished not merely for trying to do so, but only when he has actually occupied it; because the mere wish or attempt can be hidden (and hence may not he discovered), and also because the penalty laid down is very severe.鈥�(281)

This verse is quoted in 础辫补谤腻谤办补, (p. 814);鈥攁nd in 痴颈惫腻诲补谤补迟苍腻办补谤补 (p. 268), which adds the following notes:鈥斺��厂补丑腻蝉补苍补尘补产丑颈辫谤别辫蝉耻岣�鈥� sitting on the same seat,鈥斺��abhiprepsu鈥� (lit. desirous of getting at) standing here for actually getting at itself,鈥攖he man sitting upon the same seat with his superior should be 鈥榖randed on his hip and banished鈥斺��耻迟办峁涐梗峁璦,鈥� the 叠谤腻丑尘补峁嘺, 鈥�补辫补办峁涐梗峁璦箩补,鈥� the 艢奴诲谤补,鈥斺��办峁泃腻峁卥补丑鈥�, branded with red hot iron,鈥斺��spicha,鈥� a part of the loin;鈥攁nd in 痴颈惫腻诲补肠颈苍迟腻尘补峁噄 (Calcutta, p.75), which says that the 鈥榖randing鈥� is to be done with iron, and that 鈥�spicha鈥� is a part of the waist.

 

Comparative notes by various authors

Gautama (12.7).鈥斺�業f he assumes a position equal to that of twice-born men, in sitting, in lying down, in conversation, or on the road, he shall undergo corporal punishment.鈥�

膧辫补蝉迟补尘产补 (2.27.15).鈥斺�楢. 艢奴诲谤补 who assumes a position equal to that of a member of the first three castes, in conversation, on the road, or a coach, in sitting and on similar occasions, shall be flogged.鈥�

痴颈峁ａ箛耻 (5.20).鈥斺�業f he places himself on the same seat with his superior, he shall be banished with a mark on his buttocks.鈥�

狈腻谤补诲补 (15-16. 26).鈥斺�楢 low-born man, who tries to place himself on the same seat with his superior in caste, shall be branded on his hip and banished; or the King shall cause his backside to be gashed.鈥�
